Terms of Use

Effective 2026-11-02.

These terms are an agreement between you and Nookiva ("we", "us"), [registered address], about the Nookiva app for macOS, the Nookiva store and this website. By using any of them you accept these terms. If you don't, please don't use them.

1. The app

We give you a personal, non-exclusive, non-transferable licence to install and use the Nookiva app on Macs you own or control. You may not sell, rent or redistribute the app, or remove its notices. You may not reverse engineer it except where the law allows you to regardless of this sentence. The app is provided free of charge; worlds may cost money.

The app reads the positions of your desktop icons and your cursor so worlds can react to them, as described in the Privacy page. It never gives worlds access to the internet or to your files.

2. Your store account

You need an account to buy worlds. You must be old enough to form a binding contract where you live, or use the store with the permission of a parent or guardian. Keep your sign-in private: anyone with it can act as you. Tell us at walkingman149@gmail.com if you think someone else is using your account.

3. Buying worlds

Sales are made by our reseller and merchant of record, Lemon Squeezy. It processes the payment, issues your receipt and invoice, and charges any sales tax or VAT; its own buyer terms apply to the payment. The price you pay is shown at checkout before you confirm.

When you buy a world you get a personal, non-exclusive, non-transferable licence to use it with Nookiva on Macs you own or control, signed in with your account. You do not buy the world itself or any rights in it. You may not copy, resell or share a world, or extract its pictures or other content to use elsewhere.

A world you bought stays in your library and can be downloaded again, also after it is taken off sale. The exceptions: we may withdraw a world everywhere if it turns out to be unsafe, to infringe someone's rights or to break the law. If that happens to a world you paid for and we cannot give you a fixed version, we refund it.

4. Refunds

You can get a refund within 14 days of a purchase, for any reason. How, and what happens to the world, is in the Refund policy.

5. Who makes the worlds

The worlds in Nookiva are made by us, Nookiva.

6. What you may not do

7. Copyright complaints

If you believe a world infringes your rights, write to walkingman149@gmail.com with the world's store address, what you own, and how to reach you. We review every complaint and may take the world down while we do.

8. Changes and availability

We improve the app, the store and the worlds over time and may change or stop features. We try to keep the store and downloads available, but we do not promise that they always will be. We may change these terms; for a change that affects you materially we give notice on this site, and by email if you have an account, at least 30 days before it takes effect.

9. Disclaimer

To the extent the law allows, the app, the store and the worlds are provided "as is", without warranties of any kind beyond those the law gives you and cannot be excluded. Nothing in these terms limits rights you have as a consumer under the law of your country.

10. Liability

To the extent the law allows, we are not liable for indirect or consequential loss, and our total liability to you is limited to the amount you paid us in the 12 months before the claim, or USD 50 if that is more. We do not limit liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot be limited by law.

11. Ending

You can stop using Nookiva at any time and ask us to delete your account. We may suspend or close an account that seriously or repeatedly breaks these terms; where we can, we tell you why first. Worlds you bought before a closure for reasons other than a breach stay available to download for 90 days.

12. Law and disputes

These terms are governed by [governing law]. Disputes go to [courts that hear disputes], unless the law of your country gives you the right to bring a claim where you live.
